5. Donations

5.1 General Donation Terms

All donations made to the Table Temperature Alignment Project are voluntary contributions to support our research, advocacy, and educational mission. By making a donation, you acknowledge and agree to the following:

  • Donations are final and non-refundable, except as required by applicable law or at TTAP's sole discretion
  • Donations are made without expectation of goods or services in return, other than any explicitly offered donor recognition
  • TTAP reserves the right to use donations in accordance with our organizational mission and priorities

5.2 Tax-Deductible Status

The Table Temperature Alignment Project is recognized as a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code. Donations to TTAP are tax-deductible to the extent permitted by law. Donors will receive an acknowledgment letter and tax receipt for their contributions. Please consult with your tax advisor regarding the deductibility of your donation.

5.3 Recurring Donations

If you establish a recurring donation, you authorize TTAP and our payment processor to charge your designated payment method on a recurring basis until you cancel. You may cancel recurring donations at any time by contacting us at [email protected] or through your account settings.

5.4 Refund Policy

While donations are generally non-refundable, the Table Temperature Alignment Project will consider refund requests made within thirty (30) days of the donation date on a case-by-case basis. To request a refund, please contact [email protected] with your donation receipt and the reason for your request.

6. Disclaimer of Warranties

7. Limitation of Liability

IN NO EVENT SHALL THE TOTAL LIABILITY OF TTAP TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE WEBSITE OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

8. Indemnification

You agree to indemnify, defend, and hold harmless the Table Temperature Alignment Project and its directors, officers, employees, agents, volunteers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:

These Terms of Use and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Website shall be brought exclusively in the state or federal courts located in San Francisco County, California, and you hereby consent to the personal jurisdiction and venue of such courts.

10. Dispute Resolution

10.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact the Table Temperature Alignment Project at [email protected] to attempt to resolve any dispute informally. We will attempt to resolve the dispute by contacting you via email. If a dispute is not resolved within thirty (30) days of submission, either party may proceed with formal dispute resolution.

10.2 Binding Arbitration

If we are unable to resolve a dispute informally, any controversy or claim arising out of or relating to these Terms or your use of the Website shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall be conducted in San Francisco, California. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.

10.3 Class Action Waiver

YOU AND THE TABLE TEMPERATURE ALIGNMENT PROJECT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11. Changes to Terms

The Table Temperature Alignment Project reserves the right to modify, amend, or update these Terms of Use at any time, in our sole discretion. When we make changes, we will:

  • Update the “Last Updated” date at the top of these Terms
  • Post the revised Terms on this page
  • For material changes, provide notice through our Website or via email to registered users

Your continued use of the Website after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue your use of the Website.

12. General Provisions
